Kittywake

Terms of sale

These terms are for Kittywake's paid plans. They are between you and Startling Ltd, which runs Kittywake. They add to the tester terms, which still cover how Kittywake is used, and where the two differ, these terms apply to your plan. How we handle personal data, including payments, is in the privacy notice.

Who can buy

  • Anyone 18 or over with a billing address in the UK can buy a paid plan, for themselves or for an organisation. For now, paid plans are only for the UK.
  • If you buy for an organisation, you confirm you're allowed to agree to these terms for it.
  • A few parts of these terms are only for consumers, meaning people buying for themselves rather than mainly for their business or work. Those parts say so.

Who you're buying from

Startling Ltd, a company registered in England and Wales (number 12095674), whose registered office is 176 Netheroyd Hill Road, Cowcliffe, Huddersfield, West Yorkshire, HD2 2LZ. Stripe takes the payments for us.

Plans and credits

  • Each plan has a monthly price, including any VAT, and a monthly allowance of credits. Both are shown on your credits page before you buy, and the price is shown again on Stripe's payment page.
  • A meeting uses credits for Kitty's time in it, counted from when Kitty starts joining, including any time waiting to be let in. It also uses credits for turning what people say into text and for the AI's work: the notes, what people ask for and the summary. The number follows what those services cost us, so a meeting where Kitty does less uses fewer credits.
  • These don't use credits: AI work that failed, requests Kitty didn't carry out, anything Kitty made by itself that someone took down, and any time Kitty was paused.
  • Your credits page shows what each meeting used.
  • Your allowance starts again each month on your plan's monthly date. Whatever you haven't used by then doesn't carry over.
  • Credits from top-ups carry over from month to month, and are only used once your allowance has run out.
  • Credits have no cash value. You can't swap them for money or move them to another account.
  • Credits are worked out from what the services cost us, so if their prices change, so does the number of credits a meeting uses. We'll tell you at least 30 days before any other change to how credits are counted.
  • Paid plans don't have the testers' limit on meeting hours a month. The other limits in the tester terms still apply: the longest meeting, one meeting at a time, and the AI spend in one meeting.

Running low and running out

  • When the credits you have left fall to 5% of your monthly allowance, your Kittywake pages say so, and so does Kitty's screen in any call it's in.
  • When your credits run out, Kitty pauses in any call it's in, unless automatic top-ups are on. It stays in the call but stops taking notes and makes nothing until you have credits again. Paused time doesn't use credits, and you can't send Kitty to another meeting while it's paused.

Automatic top-ups

  • Top-ups are off unless you switch them on, on your credits page.
  • You choose how much each top-up is, from £10 to £500. The page shows how many credits that buys.
  • With top-ups on, each time your credits run out we charge that amount to your card straight away, without asking you again, and Kitty carries on. There's no limit on how many top-ups can be taken in a month.
  • You can switch top-ups off, or change the amount, at any time.
  • If your card declines a top-up, Kitty pauses until you update your card or try again.

Paying

  • You pay by card through Stripe, on Stripe's own page. Your card details go to Stripe, never to us.
  • Your plan starts as soon as you've paid, because you ask for that when you buy.
  • Your first month is charged when you buy. After that your plan renews, and is charged, on the same date every month until you cancel.
  • Invoices for your plan are in "Card, invoices and cancelling" on your credits page, and each top-up is listed on the credits page.
  • If a renewal payment fails, Stripe tries again for up to two weeks, and your plan carries on meanwhile. If the payment still can't be taken, your plan ends.

Changing plan

  • If you move to a bigger plan, the change happens straight away. You're charged the new plan's price, less the unused part of what you paid for your current plan this month. Your monthly date moves to that day, and your credits start again with the new plan's allowance. What was left of the old allowance ends, but credits from top-ups stay.
  • If you move to a smaller plan, the change starts on your next monthly date, and you keep this month's allowance until then.

Your right to cancel, if you're a consumer

  • If you're a consumer, you can cancel your plan within 14 days of buying it, without giving any reason.
  • To cancel, tell us before the 14 days are up, in an email to dan.akers@startlingideas.com or a letter to the address above. You can use the form at the end of these terms, but you don't have to.
  • Your plan started straight away at your request, so you pay for what you'd had of it by then. That's a share of the month's price, in proportion to the days it ran and the credits you used. We refund the rest of what you paid, including any top-up credits you hadn't used.
  • We refund you within 14 days of hearing that you're cancelling, to the card you paid with, at no cost to you.
  • After the 14 days you can still cancel at any time, as below.

Cancelling

  • You can cancel at any time in "Card, invoices and cancelling" on your credits page. There's no minimum term.
  • Your plan carries on until the end of the month you've paid for, then stops.
  • When a paid plan ends, top-ups switch off and Kitty can't join meetings for you until you choose a plan again. Credits from top-ups stay on your account in case you do.

Refunds

Apart from a consumer cancelling within 14 days, we don't refund part months, unused credits or top-ups, unless we charged you by mistake or the law says we must.

Changes to prices and plans

  • We may change prices, what a plan includes or how many credits it gives. We'll email you at least 30 days before a change affects you, and it starts from your next monthly date after that. If you don't want it, you can cancel before then.
  • If we stop a paid plan, or stop running Kittywake, we'll tell you at least 30 days before, and refund what you've paid for any time after it stops.

Our responsibility

  • We'll provide Kittywake with reasonable care and skill. It uses AI, and its notes and results can be wrong, as the tester terms explain.
  • If you're a consumer, the law gives you rights if we don't provide Kittywake with reasonable care and skill. You can have us put it right, or have some of your money back. Nothing in these terms affects those rights.
  • We aren't responsible for losses we couldn't have foreseen.
  • If you use Kittywake for your business or work, we aren't responsible for lost profits, lost business or lost data. Our total responsibility to you in any 12 months is then limited to what you paid us in those 12 months.
  • Nothing in these terms limits responsibility for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.

Ending

  • You can close your account at any time by emailing us. Your plan ends straight away, and we delete your account as the privacy notice explains. The rest of the month isn't refunded, unless you're a consumer cancelling within 14 days. Records of your payments are kept for as long as the law requires.
  • We can pause or end your plan if a payment can't be taken, or if you break these terms or the tester terms. If we end it for any other reason, we'll refund what you've paid for any time after it ends.

Changes to these terms

We'll email you at least 30 days before we change these terms. The new terms apply from your next monthly date after that. If you don't agree to them, you can cancel before then.

The law

These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute about them.
